  18. <p>     Could the Bush Administration's savings and loan bailout get
  19. any messier? Yes, in ways never imagined. In a surprise court
  20. victory last week, the ailing Olympic Federal Savings of
  21. Berwyn, Ill., convinced federal Judge Royce Lamberth that the
  22. Government's Office of Thrift Supervision currently has no
  23. power to seize the S&L. Reason: acting OTS director Salvatore
  24. Martoche and his predecessor, M. Danny Wall, were never
  25. constitutionally appointed to their posts.
  26. </p>
  27. <p>     The decision could invite lawsuits from other insolvent S&Ls
  28. seeking to avoid seizure by OTS. But the agency has received
  29. temporary permission to continue taking over bankrupt thrifts
  30. pending an appeal. Meanwhile, the Bush Administration moved
  31. quickly to nominate T. Timothy Ryan, a former top Government
  32. lawyer, as the new OTS chief and urged the Senate to expedite
  33. approval.
